Terms of Service

UserMoment is a platform that connects professional creators including photographers, videographers, social media content creators, drone operators, and business advertising specialists ("Creators") with clients ("Users") using a unique U-Code system. Creators upload media galleries linked to a U-Code, which clients can unlock using verified credentials (email or phone), or a public event passcode.

The Service also enables bookings for real-world creator services and, where offered outside the iOS client app, purchases and downloads of digital media through our marketplace technology.

You must be at least 18 years old to use UserMoment. This applies whether you use the Service as an accountless client or through a registered Creator account. By using the Service, you represent and warrant that:

• You are of legal age
• You have the authority to enter into these Terms
• All information provided is accurate and complete

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity under your account. Accountless clients remain responsible for the accuracy of information submitted for a request, booking, payment, gallery access, or support inquiry.

If you are a Creator (photographer, videographer, content creator, drone operator, or advertising specialist):

• You provide services as an independent service provider and not as an employee, agent, joint venturer, or representative of UserMoment
• You retain full ownership of your uploaded content, but grant UserMoment a non-exclusive, royalty-free license to display your galleries within the platform
• You must not upload illegal, pornographic, or copyrighted content you do not own
• You are solely responsible for the accuracy of gallery metadata, pricing, contact assignment, and delivery of services
• You are responsible for selecting accurate event eligibility information when enabling optional features such as Smart Photo Search
• You must comply with all local laws and regulations related to your services

UserMoment uses a proprietary system of U-Codes (unique gallery identifiers) that allow clients to access event-specific photos.

There are two modes of gallery access:

• Private Access: Clients must verify using a matching email or phone number assigned by the Creator
• Public Event Access: Clients must enter a shared passcode (set by the Creator) to view the gallery

UserMoment is not responsible for lost or unassigned U-Codes, mistyped verification data, or failure to access galleries due to incorrect inputs.

Smart Photo Search is an optional feature that may use face matching technology to help clients find photos of themselves in an eligible gallery. The feature is disabled by default and may be unavailable for some galleries, events, or locations.

• Creators must provide accurate event type, event state, and minor-presence information before enabling the feature
• Creators must not enable Smart Photo Search for minors, K-12/school, youth, or otherwise restricted events
• Clients must consent before submitting a selfie for Smart Photo Search
• UserMoment may disable, restrict, re-index, or delete Smart Photo Search data to comply with law, protect users, or maintain service integrity
• Smart Photo Search is provided as an assistive search tool and may not identify every matching photo

By enabling or using Smart Photo Search, you agree to comply with applicable privacy, biometric, consent, publicity, and image-use laws. Additional details are provided in our Privacy Policy.

• All transactions are processed securely via Stripe
• Creators are responsible for setting the price of their galleries or individual photos
• A client who cancels before creator acceptance receives a full refund to the original payment method or a release of any uncaptured authorization
• After creator acceptance, cancellation and refund eligibility requires support review, except for the specific Dispatch protections stated below
• For Dispatch, Stripe may place an authorization hold when the request is submitted; this is not a completed charge
• If a Dispatch request is cancelled or expires before creator acceptance, the authorization is released
• When a Creator accepts a Dispatch request, UserMoment may capture the authorized amount
• If a client cancels after acceptance but before the Creator's verified departure, an uncaptured authorization is released or a captured charge is refunded to the original payment method
• After the Creator's verified departure, the Dispatch payment is non-refundable except where applicable law requires otherwise or UserMoment determines that a service failure warrants a remedy
• If a creator declines or cancels a paid booking before the service begins, the client receives a full refund to the original payment method
• Scheduled bookings outside Dispatch follow the cancellation policy disclosed and accepted during that booking
• A creator-specific cancellation policy applies only when it is clearly disclosed and accepted during checkout; it cannot reduce mandatory or expressly stated UserMoment protections
• Gallery and media-sale refunds that are not part of a marketplace booking remain the creator's responsibility unless applicable law or a separate written UserMoment policy requires otherwise

• Creators retain ownership of content they upload, subject to any separate agreement or rights granted to a client
• By uploading media, you represent that you have the necessary rights and grant UserMoment a non-exclusive, worldwide, royalty-free license to host, process, reproduce, transmit, display, and deliver it as necessary to operate, secure, support, and promote the Service according to your settings and accepted permissions
• A client's rights to download, reproduce, publish, or commercially use delivered media are governed by the booking terms, Creator contract, media release, or other license disclosed for that transaction
• All trademarks, branding, software, and site elements developed by UserMoment remain the exclusive property of UserMoment Technologies, Inc.

You agree not to:

• Upload, share, or distribute unlawful or copyrighted material you do not own
• Attempt to bypass gallery verification mechanisms
• Use automated scripts, bots, or scraping tools
• Reverse engineer or exploit the platform's source code or systems
• Harass, impersonate, or defraud any user or creator

UserMoment is not liable for:

• Lost or deleted content
• Disputes between clients and photographers
• Missed earnings, mispriced galleries, or failure to deliver services
• Platform outages, data loss, or security breaches outside our control

The Service is provided "as is" and "as available," without warranties of any kind.

UserMoment may suspend or terminate accounts at any time for:

• Violations of these Terms
• Illegal activity
• Repeated complaints or misuse of the platform

You may request account deletion through available account controls or by contacting support. We may retain transaction, fraud-prevention, legal-acceptance, dispute, and other records when required or permitted by law.

We may update these Terms at any time. If we do, we'll notify users via the platform or email. Continued use of the Service after changes constitutes acceptance of the new Terms.

Personal information is handled according to our Privacy Policy. We use contact and verification information to provide gallery access, bookings, payments, safety, notifications, support, and legal compliance. We do not sell personal information. We disclose information to Creators and service providers only as described in the Privacy Policy or otherwise required or permitted by law.

Providing a phone number does not by itself enroll an accountless client in SMS updates. When an optional SMS checkbox or another express opt-in is presented, selecting it authorizes transactional SMS for that request. Creators and account holders may separately enable operational communications. Messages may include:

• Booking confirmations and session reminders
• Account notifications and security alerts
• Customer support communications
• Payment and transaction updates
