Terms of Service

UserMoment is a platform that connects professional creators including photographers, videographers, social media content creators, drone operators, and business advertising specialists ("Creators") with clients ("Users") using a unique U-Code system. Creators upload media galleries linked to a U-Code, which clients can unlock using verified credentials (email or phone), or a public event passcode.

The Service also enables direct purchases, downloads, and bookings through our proprietary marketplace technology.

You must be at least 18 years old to use UserMoment. By creating an account, you represent and warrant that:

• You are of legal age
• You have the authority to enter into these Terms
• All information provided is accurate and complete

You are responsible for maintaining the confidentiality of your login credentials. You are also responsible for all activity under your account.

If you are a Creator (photographer, videographer, content creator, drone operator, or advertising specialist):

• You retain full ownership of your uploaded content, but grant UserMoment a non-exclusive, royalty-free license to display your galleries within the platform
• You must not upload illegal, pornographic, or copyrighted content you do not own
• You are solely responsible for the accuracy of gallery metadata, pricing, contact assignment, and delivery of services
• You must comply with all local laws and regulations related to your services

UserMoment uses a proprietary system of U-Codes (unique gallery identifiers) that allow clients to access event-specific photos.

There are two modes of gallery access:

• Private Access: Clients must verify using a matching email or phone number assigned by the Creator
• Public Event Access: Clients must enter a shared passcode (set by the Creator) to view the gallery

UserMoment is not responsible for lost or unassigned U-Codes, mistyped verification data, or failure to access galleries due to incorrect inputs.

• All transactions are processed securely via Stripe
• Creators are responsible for setting the price of their galleries or individual photos
• UserMoment does not offer or process refunds directly. Refunds are the sole responsibility of the Creator and must be requested through their provided contact

• You retain full rights to your content
• By uploading media, you grant us a limited license to store, process, and display it solely for delivery to your intended clients
• All trademarks, branding, software, and site elements developed by UserMoment remain the exclusive property of UserMoment Technologies, Inc.

You agree not to:

• Upload, share, or distribute unlawful or copyrighted material you do not own
• Attempt to bypass gallery verification mechanisms
• Use automated scripts, bots, or scraping tools
• Reverse engineer or exploit the platform's source code or systems
• Harass, impersonate, or defraud any user or creator

UserMoment is not liable for:

• Lost or deleted content
• Disputes between clients and photographers
• Missed earnings, mispriced galleries, or failure to deliver services
• Platform outages, data loss, or security breaches outside our control

The Service is provided "as is" and "as available," without warranties of any kind.

UserMoment may suspend or terminate accounts at any time for:

• Violations of these Terms
• Illegal activity
• Repeated complaints or misuse of the platform

You may also terminate your account at any time by contacting support.

We may update these Terms at any time. If we do, we'll notify users via the platform or email. Continued use of the Service after changes constitutes acceptance of the new Terms.

All data is handled in accordance with our Privacy Policy. Verification credentials (email and phone) are encrypted and used only for access control. We do not sell or share your data with third parties without your consent.

By providing your phone number, you consent to receive SMS messages from UserMoment for:

• Booking confirmations and session reminders
• Account notifications and security alerts
• Customer support communications
• Payment and transaction updates
